CraftMall.com is a service of Visual Dynamics® LLC. By registering for an account on CraftMall.com, you are bound by the terms and policies described within this agreement.

EMAIL POLICY

Due to the nature of Internet commerce, you are required to frequently check your email when opening an account on CraftMall.com. Providing a timely response to customer inquires and order processing is paramount to running a successful business on the web.

SHIPMENT TRACKING NUMBERS

While we do not require you to provide a tracking number when shipping orders to your customers, we highly advise you to do so. Providing a shipment tracking number has become a standard for 99.9% of all Internet based sales and sellers who do not provide shipment tracking numbers are often considered by many as "unprofessional". It is also important to note that in the event that a customer files a complaint that they never received their item or items, and you did not ship with a tracking number, there is no way to verify the arrival of the shipment. In such an event, you will be required to either refund their money or reship the item or items.

BILLING POLICY

There are no contracts or required time commitments to open an account on CraftMall.com. All service fees are billed monthly and will show on your bank statement as "CraftMall.com". You are required to keep your credit card information up-to-date for your account on CraftMall.com for proper monthly billing. In the event that your credit card has expired or is declined, we will notify you via the email address provided for your account. It is common courtesy to reply to us in a timely manner in order to resolve the situation. If your account becomes overdue, your account will be suspended and your products will no longer be available for sale on CraftMall.com.

Due to the resources required to provide this service and the costs associated with electronic processing, all sales are final. You can close your account at any time, however, if your account closure occurs after your account has been billed for the next month of service, the charge will not be refunded. Furthermore, our accounting system is maintained by humans. Account closures can take up to 3 business days to process. It is your responsibility to provide adequate time for your account closure to be processed and a 3 business day advance notice is required. If in the event that your account closure is initiated after your monthly billing date or is initiated without adequate time to process the closure and you are billed, the charge will not be refunded.

PRIVACY POLICY

All crafters must abide by the privacy policy set in place for this web site as a whole. Any and all customer information collected on this web site will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned. Any information provided by the customer will be held with the utmost care and will not be used in ways that the customer has not consented to.

SERVICE USAGE

Competing services such as "Brick and Mortar" Craft Malls or online based Craft Malls are not allowed to sell their vendor's products through our service. Each vendor must register their own account with us.

You understand that Visual Dynamics® LLC has no involvement in the transaction between you and the buyer. You will be responsible to promptly and properly deliver the purchased products in accordance with the terms of the purchase. You will also be responsible for directly handling any questions or concerns expressed by the buyer of such products.

Visual Dynamics® LLC reserves the right, but has no obligation, to monitor activity on CraftMall.com, including the investigation of any violation or purported violation of its rules. As a result of such investigation, Visual Dynamics® LLC, in its sole and absolute discretion, may take such action as it deems necessary to cause compliance with its rules and any governing law, including restricting, limiting or denying your access to CraftMall.com, causing the editing or removal of a product page, or issuing a written warning of a rules violation and requiring that such violation be timely corrected. The following are examples of violations that Visual Dynamics® LLC, in its sole and absolute discretion, may take action upon:

• Referring visitors to another web site
• Posting products that are unrelated to the Arts and Crafts industry
• Posting material that is deemed as objectionable content
• Rude or unprofessional communication with customers or CraftMall.com staff.

Furthermore, Visual Dynamics® LLC reserves the right, in its sole and absolute discretion to determine within which (product) category your product(s) shall appear under. Visual Dynamics® LLC further reserves the right to re-classify such placement in its sole and absolute discretion.

REPRESENTATIONS AND WARRANTIES

You represent and warrant to Visual Dynamics® LLC that:

• You own the products posted for sale on CraftMall.com, you are free to sell such products, including sales on or through, or facilitated on or through a global computer network, and are legally capable of selling such products and entering into and performing an agreement for the sale of such products;
• Any description of the products posted on CraftMall.com is true and accurate, and is not misleading or otherwise fraudulent;
• The products posted on CraftMall.com, and as delivered to the buyer, are and will be free of material defect or damage, and if they are not, you will immediately remedy the situation to the reasonable satisfaction of the buyer;
• You will immediately handle any complaint or question raised by the buyer;
• The products posted on CraftMall.com are safe, are not illegal or dangerous, and do not infringe upon anybody's rights of any nature (for example, trademark, copyright or patent).
• You will comply with all applicable laws, rules and ordinances.
• Visual Dynamics® LLC makes no representation or warranty of any kind, whether express or implied, including, without limitation, the implied warranty of merchantability or fitness for a particular purpose. Visual Dynamics® LLC disclaims all such warranties to the fullest extent permissible under applicable law.

INDEMNIFICATION

You understand that because Visual Dynamics® LLC cannot and does not attempt to verify the information you post on CraftMall.com or provide to any prospective purchaser concerning your products, or monitor your compliance with the terms of this agreement, and because Visual Dynamics® LLC is not involved in the sales transaction or the delivery of the products purchased, Visual Dynamics® LLC cannot and will not accept any liability that results from the display, offering for sale, sale or delivery of your products through CraftMall.com. Therefore, you agree to defend, indemnify and hold harmless Visual Dynamics® LLC, its officers, directors, employees, affiliates, agents, attorneys, and any other related entity, from and against any and all demands, claims, actions, causes of action, liabilities, suits, proceedings, investigations or inquiries, or any settlement thereto, and all related expenses, including, but not limited, to all litigation expenses (including reasonable attorneys' fees and court costs) and settlement amounts, as well as all special and consequential damages and damage to Visual Dynamics® LLC's goodwill and reputation that arises from or in connection with the display, sale, transfer or use of your products displayed upon or acquired through CraftMall.com.

TERMINATION OF THIS AGREEMENT

Without limiting other remedies, Visual Dynamics® LLC may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your access to CraftMall.com and refuse to provide our services to you: (a) if you breach this agreement; or (b) if Visual Dynamics LLC reasonably believes that your actions may cause legal liability for you, our users or us.

Visual Dynamics® LLC reserves the right to change the terms and policies of this agreement at any time.
